These general conditions of sale apply between FRENCH EPOXY and any person visiting or making a purchase via the website www.frenchepoxy.com or by telephone.

1) Field of application

The Customer can only order if he/she accepts all of the provisions set out below.

The customer acknowledges having read, prior to the validation of his order, these general conditions of sale. He accepts them by clicking on the validation button of his order on the site or by validating the payment of his order.

At the time of the order a copy is sent to the Customer as an attachment to the order confirmation email.

FRENCH EPOXY can modify at any time the present general conditions of sale.

In these GTC, the term “customer” refers to both a consumer and a professional.

The date of the last update of the general conditions of sale is indicated at the bottom of this page.

2) Conclusion of the contract

Before placing a firm and definitive order, the Customer has the possibility of correcting his information by e-mail: frenchepoxy@gmail.com

The Customer must ensure the accuracy of the e-mail address provided for order processing purposes and to receive e-mails sent by FRENCH EPOXY.

The contract will be concluded, in application of the provisions of the Civil Code, as soon as the Customer clicks on the “Confirm and Pay” button, by which the Customer will have confirmed the shopping cart after having been able to correct it. Also the contract will be concluded as soon as the signed estimate is validated and sent by e-mail or by post by the Customer.

Furthermore, FRENCH EPOXY reserves the right to cancel any order that could not be completed due to compelling reasons of manufacturing process (e.g.: force majeure*).

Cancellation of an order at the Customer’s initiative is possible before any preparation (cutting, rounding, holes) of the pieces of wood chosen by the Customer and within a maximum period of 14 days, FRENCH EPOXY undertakes to refund the full amount of the deposit paid for this order.

It is specified that if the product is made to measure or includes a clearly personalized element, the Customer will not be able to ask for the cancellation of his order in accordance with the article L 221-28 of the Code of consumption which excludes the possibility for the Customer to take advantage of his right of retractation, such as envisaged in article 8 below.

Only the French language is valid for the conclusion of the contract.

3) Prices and payment terms

3.1 Awards.

The prices are expressed in euros and include VAT.

The price charged to the customer is the one displayed on the summary just before the Customer confirms his order. This price is recalled on the order confirmation.

The invoice will be sent by email to the Customer as soon as the order is shipped.

Billing information cannot be changed after the order has been shipped.

3.2 Terms of payment

For a payment on the website by credit card or STRIPE: The order will be valid only once the total payment of the order has been confirmed by the payment provider.

Payment by check or bank transfer: The order is considered valid after receipt of funds.

FRENCH EPOXY offers the possibility to place an order (s) off the website with a percentage of deposit and a total outstanding fixed directly between the Customer and FRENCH EPOXY.

In case of failure to receive the funds from the deposit of the check or bank transfer within seventy-two (72) hours from the validation of the basket, the order will be considered as cancelled.

All completed orders will be fully cleared before shipping to the Customer.

4) Delivery

4.1 Terms of delivery

The Customer is informed by FRENCH EPOXY of the availability of the product(s) and the delivery time when placing the order.

FRENCH EPOXY sends the ordered product in the exact condition it was described during the sale and confirmed at the time of order. FRENCH EPOXY will ensure the delivery of the Customer’s order with the best possible packaging.

The Customer is informed by telephone, e-mail when his order leaves and of the steps to follow to receive his package.

The assembly service of the product(s) upon delivery must be specified to our customer service and will be subject to additional charges.

4.2 Impediment

Additional charges for a new delivery will be deducted from the Customer and will be due before any new shipment in the following cases:

– in case of absence of the Customer on the day of delivery,

– in case of error committed by the Customer in the indication of his delivery address,

– as well as in case of impossibility of delivery because of difficulties of access not announced beforehand.

5) Receiving the package

The customer must sign the delivery note.

If the package has been damaged, the Customer must refuse it and note explicit reservations on the delivery slip. The Customer must also notify FRENCH EPOXY of any anomalies and confirm his reservations and refusal to accept the package.

FRENCH EPOXY will ensure the return of the order and will propose either the remanufacture of the damaged product(s) or the refund.

6) Right of withdrawal

Consumer customers have a right of withdrawal.

The exercise of the right of withdrawal by the Customer does not involve any penalty.

Cancellation of an order at the initiative of the Customer is possible before the personalized cuts of the pieces of wood chosen by the Customer and within a maximum period of 14 days, FRENCH EPOXY undertakes to refund in full the deposit paid for this order.

If the customer validates the formwork and the choice of the resin coloring during the order, there will be no possible complaint from the customer and no refund will be granted to the customer.

Thus, the Customer acknowledges three exceptions in which the right of withdrawal does not apply:

– For purchases made at fairs or exhibitions, in accordance with Article L224-59 of the French Consumer Code, except if these purchases are financed with an assigned credit.

– For products made to measure or comprising a clearly personalized element in accordance with Article L221-18 of the Consumer Code.

7) Compliance and Legal Guarantees

7.1 Product Information

The Customer acknowledges that all Products offered by FRENCH EPOXY are handcrafted and are therefore unique pieces.

The identical reproduction of the delivered products and those represented on the Site cannot therefore exist.

These differences, as long as they do not concern the essential characteristics of the product(s) and do not affect their quality, cannot justify a cancellation of the order or a refusal of delivery.

In addition, due to technical imponderables inherent to the shooting operations and to the Internet navigation software and/or to the display monitors, the rendering of the colors on the Site is indicative and can in no way be guaranteed to be faithful to the reality of the colors of the products represented. Differences in color may occur and cannot be held against FRENCH EPOXY.

Finally, FRENCH EPOXY cannot be held responsible for any errors or omissions that may have occurred despite all our care and careful monitoring.

7.2 Legal guarantees

The company FRENCH EPOXY is held responsible for the lack of conformity of the goods to the contract under the conditions provided in Articles L.217-4 of the Civil Code.

He has a period of two years from the delivery of the property to act.

He may choose between repairing or replacing the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code.

The Customer can decide to implement the guarantee against the hidden defects of the thing sold within the meaning of article 1641 of the civil code. In this case, the Customer can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

7.3 Warranty exclusions

FRENCH EPOXY cannot be held responsible in the following cases:

– in case of misuse by the Customer, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure,

– Damage caused by the customer (heat sources),

– Discoloration, alteration or any change or deterioration in appearance due:

  • to the excessive action of natural or artificial light.
  • the use of any maintenance product not adapted to the coating, as well as the non-respect of the maintenance conditions.
  • external causes: domestic accidents, water damage, stains, burns, scratches, animals, etc…
  • Incorrect assembly, adjustment or other work carried out by persons not authorized by FRENCH EPOXY.

8) COOKIE POLICY

The site www.frenchepoxy.com informs you that cookies can be implanted on your computer, tablet or smartphone. The information collected is exclusively intended for the site www.frenchepoxy.com. If your browser is configured to block the saving of cookies, we will no longer be able to guarantee the proper functioning of our website. You can accept or decline the use of cookies by setting your log-in device appropriately.

9) SECURING BANK DATA

The site is subject to a security system that uses the SSL (Secure Socket Layer) protocol to encrypt the customer’s banking information. Any unpaid order due to fraudulent use of a credit card will result in the registration of the details related to the order in the payment incident file.

In order to limit fraud, the site may ask the customer to provide all the necessary documents to complete the order (identity documents, proof of address, etc.). The products remain the property of FRENCH EPOXY until the Customer signs the purchase order.

n°2004-801 of August 6, 2004 and the General Regulation on Data Protection, the Customer has a
right of access, rectification, portability and deletion of information concerning him/her as well as a right to
to oppose the processing of his data.

13) Intellectual Property
The presentation and content of the FRENCH EPOXY website, including but not limited to logos, text,
photographs, images, drawings and the graphic charter, constitute, together, works protected by
intellectual property rights or human rights, and are the exclusive property of FRENCH
EPOXY.
The reproduction or representation, total or partial of this content, without the express prior consent of
FRENCH EPOXY, holder of these rights, is prohibited and would constitute a counterfeit sanctioned by the
provisions of the Intellectual Property Code and/or a tort of such nature as to engage the liability of the
civil liability of violators of the above rights.
Similarly, it is forbidden to copy, extract, distribute or modify the content of this website for the following purposes
commercial.
Downloading and printing of text, images and graphics is only allowed if
private and non-commercial use. Commercial use requires the prior written consent of FRENCH
EPOXY.
Finally, the Customer may not access the contents of the database and any other element of the Website and
display them only for non-commercial and private use.

14) Language / applicable law, Mediation

The present GTC and contract are subject to French law.
The parties will seek, before any litigation, a possible amicable agreement. In the absence of an amicable agreement,
any dispute relating to the formation, execution, interpretation and termination to which the GTC could give rise
even in the event of recourse in warranty or of plurality of defendants, is of the exclusive competence of the
French courts.
However, the Customer, a consumer, cannot be deprived of the protection afforded to him by the provisions
taken by a Member State of the European Union pursuant to Directive 2011/83/EU of the European Parliament and of the Council
and Council of 25 October 2011 on consumer rights, amending Directive
93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing the
Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council, where the
contract concluded at a distance or off-premises has a close connection with the territory of that State.
In the event of a dispute, the Customer may have recourse to the conventional mediation procedure or to any other
alternative dispute resolution under the conditions of article 1528 and following of the French Code of
civil procedure.
Concerning mediation and in accordance with Article R 152-1 of the Consumer Code, the Customer may
free of charge to use the MEDICYS mediation service, by electronic means: www.medicys.fr, or by
postal address: MEDICYS – Mediation and out-of-court settlement center of judicial officers – 73, Boulevard de
Clichy, 75009 – Paris, for all claims already submitted in writing to the customer service of
FRENCH EPOXY for less than a year and not satisfied.
